The petitioner is apprehending his arrest in connection with S.C. No.1175 of 2016, arising out of Complaint Case No. 1423C of 2016 lodged for the offences punishable under Sections 323, 498A of the Indian Penal Code and 4 of Dowry Prohibition Act.

It has been submitted on behalf of the petitioner that petitioner has a child aged about two years and, as such, he is ready to keep opposite party No.2 with all care and protection and she is also ready to live with him.

Heard learned APP also.

No.14854 of 2017 (2) dt.04-04-2017 2/2 Having heard both sides and in view of submission of learned counsel for the petitioner, let petitioner surrender before the court below within two weeks and on his so surrendering he will be released on bail by the court below provisionally for a period of six months and, in the meantime, learned court below will call upon opposite party No.2 by fixing a date, on which date petitioner will also appear and, as per submission of petitioner that he is ready to keep opposite party No.2 with him, the court will allow them to live together and the court below will watch the conduct of the parties by calling them every month on a date fixed for a period of six months and on being satisfied, the court below will confirm the bail bond of the petitioner and if the opposite party No.2 is not ready to co-operate in this case, except on her genuine grievances, the court below will confirm the bail bond of the petitioner.

With the aforesaid observation, this application is disposed of.
