The petitioner is apprehending his arrest in connection with Complaint Case No.1545 of 2015 registered for offences punishable under Sections498A and 323 of the Indian Penal Code. The allegation against the petitioner is under Section 498A and other Sections of IPC and the petitioner is husband. It is submitted at the very outset on behalf of the petitioner that the parties have compromised the case outside the court and a compromise petition has also been filed, kept as Annexure-2, in which no date has been mentioned as to when this petition was filed.
Heard learned A.P.P. also.
Having heard both sides, considering submission of the learned counsel for the petitioner and also considering Annexure-2
Patna High Court Cr.Misc. No.16699 of 2017 (2) dt.12-04-2017 2/2 of the petition, the petitioner is directed to surrender before the learned court below within a period of six weeks and make prayer for regular bail and the learned court below will examine the aforesaid compromise petition and also call upon the Opposite Party No.2 and if the compromise petition is found to be true, he will release the petitioner on bail on his own satisfaction, otherwise, the application for bail of the petitioner shall be rejected.
With the aforesaid observation, this application is disposed of.
