2. The petitioners are apprehending their arrest in connection with Basantpur P.S. Case No.622 of 2023, registered for the offences punishable under Sections 341/323/354/307/506/379/504/34 of the Indian Penal Code.
3. As per the prosecution, FIR has been lodged against six named accused persons including the present petitioners. It has been alleged in the FIR that all accused persons due to land dispute gathered at the house of the
Patna High Court CR. MISC. No.48095 of 2024(3) dt.21-09-2024 2/3 informant and started abusing. Allegation of attack by lathi, danda etc. is there due to which injury had been caused to the informant.
4. Learned Counsel for the petitioners submits that the FIR itself is very much clear that the dispute occurred due to land dispute. He further submits that injury report has been annexed, which indicates that injury is simple in nature. He further submits that antecedent of the petitioners are clean. He further submits that there are general and omnibus allegation against the petitioners. It has not been narrated that who had attacked by lathi. He further submits that allegation of snatching Mangalsutra is against petitioner No.2.
5. Learned Additional Public Prosecutor for the State opposes the prayer for bail but fairly submits that injury is simple in nature.
6. In the present facts and circumstances of the case, the petitioners, above named, are directed to be released on anticipatory bail, in the event of arrest or surrender before the Court below within a period of four weeks from today, on furnishing bail bond of Rs.30,000/- (Three Thousand) each with two sureties of the like amount each to the satisfaction of A.C.J.M.-X, Siwan, in connection with Basantpur P.S. Case No.
