JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-05-2017 The petitioner is apprehending his arrest in connection with Sukhani P.S. Case No. 16 of 2016, registered for offences punishable under Section 414 of Indian Penal Code. It has been submitted on behalf of the petitioner that petitioner's name has surfaced in this case only on the basis of confessional statement of apprehended person and except that there is nothing against the petitioner so as to connect him with the present case. Petitioner has no criminal antecedent and nothing has been recovered either from his conscious possession or from his house and further the persons, who were apprehended on the spot has already been granted regular bail by this Court vide order dated 18.04.2017, passed in Criminal Miscellaneous No. 2778 of 2017.

Having heard both sides, considering the facts and circumstances of the case, nature of allegation, I am not inclined to grant the petitioner, privilege of anticipatory bail rater petitioner should surrender before the court below and make prayer for regular bail and if any such application is filed, the court below after considering the submission of learned counsel for the petitioner shall pass an appropriate order, if possible on the same day, without being prejudiced by the order of this Court. With the above observation, this application is disposed of.
