JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in Rafiganj P.S. Case No.11/16 registered for the offences under Sections 147, 341, 323, 308, 379, 504 and 506 of the I.P.C. The allegation of the informant is that five persons including the petitioner came near the informant, Nand Kumar Gupta, started to assault him and snatched gold chain, ring and cash Rs.50,000/-.At that time they also threatened him to kill and also lit fire to his house and khalihan. They also tried to put him on the railway track.

Learned counsel for the petitioner submits that the petitioner and the informant are agnates and on account of some

Moreover occurrence of simple mar pit took place and injuries are simple in nature. The petitioner is a college student who has no criminal antecedent. Considering the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Aurangabad, in Rafiganj P.S.
