Learned counsel appearing on behalf of the petitioners would submit that the case of the petitioners is covered by the decision in C.W.J.C. No. 11428 of 2012 dated 6.7.2012 (Annexure-8).

Without going to the nitty-gritty of this case, the writ petition is disposed of with direction to the respondents to examine the claim of the petitioners and if it is found that the

No. 11428 of 2012, similar benefit should be extended to the petitioners in view of the litigation policy particularly in para-4C thereof and judgment of the full bench reported in 2018(2) page 929.

Necessary decision in this regard may be taken by the respondents within a maximum period of four months from the date of receipt/production of a copy of this order. With the aforesaid, the writ petition stands disposed of.
