JUSTICE VINOD KUMAR SINHA ORAL ORDER 01-03-2017 The petitioner is apprehending his arrest in connection with Agion P.S. Case No. 93 of 2016, registered for offences punishable under Sections 30(A) and 56 of Bihar Prohibition and Excise Act.

It has been submitted on behalf of the petitioner that petitioner's name has surfaced in this case only on the basis of confessional statement of accused persons; however no recovery has been made from the possession of the petitioner. However, in view of Section 76 (2) of Bihar Prohibition and Excise Act, let petitioner surrender before the Court below and make above prayer, and the Court below after considering the submissions of learned counsel for the petitioner that petitioner has been made accused in this case only on the basis of suspicion,

Patna High Court Cr.Misc. No.8483 of 2017 (2) dt.01-03-2017 2/2 shall pass an appropriate order, without being prejudiced by the order of this Court.

With the above observation, this application is disposed of.
