2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 302 of the Indian Penal Code and Sections 25(1-b)a, 27 of the Arms Act.

3. The case of the prosecution is that the brother of the informant was shot dead by some unknown miscreants.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Learned counsel for the petitioner has submitted that during investigation, one Rishi Kumar has given his confessional statement and in his confessional statement, he has named this petitioner. From perusal of the confessional statement of said Rishi Kumar, it transpires that the role of this petitioner was

Patna High Court CR. MISC. No.50212 of 2025(3) dt.16-10-2025 2/2 only that of planning. Learned counsel for the petitioner has submitted that save and except confessional statement of Rishi, there is nothing against this petitioner. Moreover, he is languishing in judicial custody since 18.12.2024.

5. Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Hajipur Town P.S. Case No. 23 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur.
