The petitioner is apprehending his arrest in connection with Jankinagar P.S. Case No. 149 of 2015 registered for the offences punishable under Sections 406, 409, 420, 467, 468, 471 and 120B of the Indian Penal Code.
It has been submitted on behalf of the petitioner that allegation against the petitioner is that he had passed the files of two beneficiaries relating to Indira Awas Yojna and except that there is nothing against the petitioner and further there is allegation misappropriation of funds by other co-accused persons of Indira Awas Yojna and co-accused having similar allegation have been granted anticipatory bail by this Court in Cr.Misc.Nos. 4887, 6904 and 6901, all of 2017, vide orders dated 15.2.2017, 14.2.2017 & 13.2.2017 respectively (Annexure-3 series). Heard learned APP also.

No.12599 of 2017 (2) dt.30-03-2017 2/2 Having heard both sides and considering the facts and circumstances of the case and also in view of the fact that similarly situated co-accused having been granted anticipatory bail by this Court, let the petitioner, named above, in the event of his arrest or surrender in the court within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sri D. Prakash, Judicial Magistrate, 1st Class, Purnea, in connection with Jankinagar P.S.Case No.
149 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions that petitioner shall co-operate in the investigation and make himself available before the police as and when required and in the event of failure on his part to appear before the police on two consecutive dates, the prosecution shall be free to move for cancellation of his bail bonds and further petitioner will not induce any witness or tamper with the evidence.
