JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-07-2021 As prayed for, through Video Conferencing, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 26.12.2020 within four weeks of starting of the Court proceeding in physical mode in normal course.

Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner apprehends his arrest in connection with Gogri P.S. Case No.188 of 2020 registered under Sections 447, 341, 323, 504, 506, 354, 509, 307, 385 and 379/34 of the Indian Penal Code besides Section 27 of the Arms Act. The accusation is that on 24.05.2020, Dinesh Singh, his wife Sabita Devi and Roshi Singh having illegal arms in

On protest, firing was made on the instruction of Ex-Sarpanch Binod Singh, which passed over by the side of temporal region of the son of the informant. Thereafter, the informant gave an application at Police Station on 25.05.2020 and, on the next day, the police came in the village but after returning of the police force, Binod Singh, Ajay Singh (petitioner), Dinesh Singh and Roshi Singh having illegal arms in their hands entered into the house of the informant and started to abuse and also scuffled with the ladies and took Rs.30,000/-. Thereafter, all also made demand of ransom of Rs.

1,00,000/- per year from the informant saying that if the same is not paid, he and his entire family would be killed. Learned counsel for the petitioner submits that the petitioner and other F.I.R. named accused are the co-villagers of the informant and due to enmity, the informant has lodged the present case with false allegation. The petitioner has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-
