2. The petitioner has preferred this application for grant of regular bail in connection with Masaurhi P.S. Case No. 219 of 2026 registered for the offences punishable under Sections 103, 61(2), 3(5) of the B.N.S.
3. As per the prosecution case, on 26.03.2026 at about 11:00 PM, the deceased, Ajeet Kumar, informed the informant, Sanju Devi, by mobile phone that accused Sonu Kumar had taken him away and owing to prior enmity, assaulted him before abandoning him near Village Bishbigha Ushmanchak. He was subsequently found by his brother, Vimal Kumar, who took him to Sub-Divisional Hospital, Masaurhi, and was declared dead. It
Patna High Court CR. MISC. No.45470 of 2026(2) dt.08-07-2026 2/3 is further alleged that accused Sonu Kumar, Sangeeta Devi, and Sanjay Yadav, in furtherance of a criminal conspiracy, administered a poisonous substance and caused his death.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It has further been submitted that petitioner is motherin-law of the deceased Ajit Kumar, and there is only suspicion against her. It has further been submitted that there is no eye witness to the alleged occurrence. It has also been submitted referring to the impugned order that there is no external and internal injuries upon the person of the deceased and opinion of the cause of death has been reserved till report of viscera. It has further been submitted referring to the impugned order that except suspicion there is nothing against the petitioner. It has next been submitted that the petitioner is a lady and there is no motive against her. Lastly, it has been submitted that the petitioner has got no criminal antecedents and he is in custody since 28.03.2026.
5. Learned APP for the State has vehemently opposed the prayer for bail of the petitioner.
6. Heard the parties and perused the record.
7. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.45470 of 2026(2) dt.08-07-2026 3/3 case, let the petitioner above-named, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Masaurhi, Patna, in connection with Masaurhi P.S. Case No. 219 of 2026.
8. The application stands allowed.
