JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-07-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in a case registered for the offence punishable under Section 461, 379, 411 of the Indian Penal Code.

As per the prosecution case, some unknown thieves committed theft in the shop of informant and stolen cash and mobile phones.

Learned counsel appearing for the petitioner submits that petitioner is not named in the FIR. The name of petitioner has transpired in this case during the course of investigation No incriminating article has been recovered from the possession of the petitioner. Petitioner claims clean antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail and submits that during the course

No.54835 of 2021(3) dt.18-07-2022 2/2 of investigation police perused SDR of IEMI no. of stolen mobiles and found that IMEI No. 358974082521885 in which SIM no. 9097831932 was used, which is issued in the name of petitioner which shows complicity of this petitioner in the aforesaid crime.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
