The petitioners apprehend their arrest in Dagarwa P.S. Case No. 35 of 2016 instituted for the offence under Sections 341, 323, 324, 307, 504 and 34 of the Indian Penal Code. As per written report, petitioner No. 1 assaulted the informant with leg and petitioner No. 2 slapped the informant. The allegation against co-accused Md. Aslam is of assaulting with a Dabia on the head of the informant. It has been submitted in paragraph-3 of the bail petition that the petitioners have no criminal antecedent.

Counsel for the informant and A.P.P. have opposed the prayer for anticipatory bail.

Patna High Court Cr.Misc. No.10100 of 2017 (2) dt.09-03-2017 2/2 Considering the facts and circumstances of the case, prayer for anticipatory bail of the petitioners is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today, in connection with Dagarwa P.S. Case No. 35 of 2016, they shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Purnea, subject to the conditions as laid down under Section 438 (2) Cr.
