JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 01-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Lalganj P.S. Case No. 269 of 2016, registered for the offences punishable under Sections 353,506/34 of the Indian Penal Code.

Allegedly, the petitioner obstructed the informant and others personnel of electricity department to disconnect the electric connection of account No. LG 1260 having dues of Rs. 38,882/-. The petitioner called Harendra Singh and both misbehaved with the informant and others and did not allow them to disconnect the electric connection.

Submission is of false implication and that after lodging of this case the electrical dues has already been deposited

Patna High Court Cr.Misc. No.7710 of 2017 (2) dt.01-03-2017 2/2 by the father of the petitioner and now there is no dues, the informant only with a view to pressurize the petitioner and others have lodged this false case, no such occurrence has taken place. As a matter of fact, the petitioner has taken time to deposit the said electrical dues and requested not to disconnect the electric connection and then the informant became angry and lodged this false case.

The learned A.P.P. opposes the prayer of pre-arrest bail.

In the facts and circumstances as stated above, considering that the dues amount has already been deposited and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Lalganj P.S. Case No. 269 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
