JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 376 and 511 of the Indian Penal Code.
Allegation against the petitioner is of attempt to commit rape upon complainant.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that there was dispute between the husband of the complainant and the petitioner with respect to the construction of a house but the husband of the complainant had left work of the petitioner on some pretext and has not returned money.
Heard learned A.P.P. also. He submits that the
Patna High Court Cr.Misc. No.16763 of 2017 (2) dt.17-04-2017 2/2 occurrence took place on 25.06.2014 and the complaint petition has been filed on 01.07.2014. As such, there is delay in filing the complaint case.
Having heard both sides, in view of the facts and circumstances stated above, let above named petitioner surrender in the court below, i.e., 1st Addl. Chief Judicial Magistrate, Purnea, in connection with Complaint Case no. 2322 of 2014 within a period of two weeks from the date of receipt/production of a copy of this order and the court below will enlarge the petitioner on bail on furnishing bail bond of Rs.25,000/- (Twenty-five thousand only) with two sureties of the like amount each to its satisfaction under Section 438(2) of the Code of Criminal Procedure and also subject to the conditions that (1) bailors should be local having sufficient immovable property within the jurisdiction of the court concerned, (2) petitioner shall cooperate in the investigation and make himself available before the police as and when required.
