Petitioners apprehend their arrest in a case registered for the offence punishable under Section 302, 120B/34 of the Indian Penal Code and u/s 27 of Arms Act.

As per the prosecution case,these petitioners along with other accused persons conspired and killed the brother of informant and took away Rani Devi with them. Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in the case. It is submitted that police after investigation found the case false against these petitioners but differing with the same

Learned counsel appearing for the State opposed the prayer for anticipatory bail and submitted that petitioners are named in the FIR and there is specific allegation against them that they along with other accused persons conspired and killed the brother of informant and took away Rani Devi with them. During the course of investigation ample material has been collected against these petitioners to show their involvement in the aforesaid crime.

Considering the nature of accusation and gravity of the offence, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
