JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 323, 504, 354/34 and other allied sections of Indian Penal Code.
As per FIR, this petitioner along with other accused persons entered into house of the informant and ordered to marry her daughter with son of brother-in-law of one co-accused Kunal Yadav and on refusal by the informant they abused, demanded Rs 1 lac and threatened her to face the dyer consequences.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. It is submitted that due to previous dispute between the parties, informant has lodged the instant case against the
Patna High Court CR. MISC. No.47965 of 2022(2) dt.09-11-2022 2/2 petitioner. From perusal of the FIR it is apparent that the alleged occurrence took place on 26.04.2022 but FIR for the same has been lodged after delay of 9 days without giving any satisfactory explanation.
Learned counsel for the informant vehemently opposes the bail application.
Considering the nature of accusation and the fact that there is delay of 9 days in lodging FIR without any satisfactory explanation, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Patna City in Fatuha P. S. Case No. 335 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
