The petitioners apprehend their arrest in connection with Nawada Town P.S. Case no. 404 of 2013, registered under Sections 341, 323, 342 and 307/34 of the Indian Penal Code. The accusation is that the informant Bhola Kumar was assaulted by the people of the V.I.P Colony on the allegation of teasing the girl by him and he sustained grievous injury. The informant was rushed to the Sadar Hospital, Nawada, who latter on died in course of treatment at Patna.
Learned counsel for the petitioner submits that it would appear from the F.I.R. that initially on the basis of the written report of Bhola Kumar Nawada Town P.S. Case no. 404 of 2013, registered under Sections 341, 323, 342 and 307/34 of the Indian Penal Code
Patna High Court Cr.Misc. No.15271 of 2017 (6) dt.17-07-2017 2/2 against unknown on 22.07.2013, who died on 23.07.2013 in private clinic at Patna and after about 3 years, Priyanka Kumari and father of the informant have stated that the petitioners were also present in the mob indulged causing assault to the informant/deceased. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in connection with Nawada Town P.S. Case No. 404 of 2013, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
