====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 12-08-2024 Heard learned counsel for the petitioners, learned counsel for the informant and learned APP for the State.
2. The petitioners have preferred this application for grant of regular bail in connection with Tekari P.S. Case No. 407 of 2023 dated 04.07.2023 registered for the offences punishable under sections 341, 323, 324, 307, 379, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have assaulted the informant's husband by an iron rod. It is also alleged that the co-accused,
Patna High Court CR. MISC. No.48014 of 2024(3) dt.12-08-2024 2/3 Dhananjay Sharma took away two mobile phones and the petitioner took away Rs.5000/- from his pocket.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. Nothing have been recovered from the conscious possession of the petitioners. The petitioners have no concern with the alleged offence. The petitioner no.1 has three criminal antecedents and petitioner no.2 has one criminal antecedents as stated in para 3 and 4 of the counter affidavit filed on behalf of the informant which is kept on record. The petitioners are in custody since 05.04.2024.
5. Learned A.P.P. for the State and learned counsel for the informant have opposed the bail petition of the petitioners by submitting that the injury no. 1, 2 and 4 are grievous in nature caused by hard and blunt substance. The specific allegation of assault is against the co-accused, Shivam Kumar.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VI, Gaya, in
Patna High Court CR. MISC. No.48014 of 2024(3) dt.12-08-2024 3/3 connection with Tekari P.S. Case No. 407 of 2023, with a condition:- (i) That the he petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioners will liable to be canceled.
7. The application stands allowed.
