JUSTICE BIRENDRA KUMAR ORAL ORDER 07-04-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 420, 406, 120(B) and 504/34 of the Indian Penal Code.

For land dispute between the parties, initially, complaint case was filed which was registered as Purnea Sadar Police Station Case No. 431 of 2013 under Section 420 and 406 of

Patna High Court Cr.Misc. No.15140 of 2017 (2) dt.07-04-2017 2/2 the Penal Code against the petitioners. The police did not send up the petitioners for trial after investigation of the case. However, the learned Magistrate disagreed with the police report and has taken cognizance against the petitioners.

Considering the nature of dispute, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Purnea/successor Court in connection with Sadar Police Station Case No. 431 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
