The petitioner has challenged the appointment of Babita Kumari, private-respondent no. 8 on the post of Vikash Mitra in the Bela Gram Panchayat under Babu Barhi Block in the district of Madhubani before the District Magistrate for her having played fraud on the system by procuring two matriculation certificates; one from Bihar

Patna High Court CWJC No.14036 of 2019(2) dt.17-07-2019 2/3 Sanskrit Shiksha Board; and other from the Bihar School Examination Board.

The representation / complaint filed by the petitioner before the District Magistrate, Madhubani, contained in Annexure- 7 to the writ petition, has not yet been responded to.

When the grievance of the petitioner was not redressed, she preferred a petition / appeal before the Bihar State Mahadalit Vikash Mission, which has also remained unheeded till date.

Learned counsel for the State, however, submits that in both the complaints and the appeal, referred to above, the applications are undated and there does not seem to have any registration of the aforesaid petitions / complaints / appeal.

Under the aforesaid circumstances, the petitioner is directed to make a fresh complaint before the District Magistrate / Vikash Mission authority within a period of four weeks, who, on receipt of such complaint shall look into the matter and pass a reasoned order in accordance with law

Patna High Court CWJC No.14036 of 2019(2) dt.17-07-2019 3/3 within a further period of eight weeks of the receipt of such representation.

If the petitioner still feels dissatisfied, she can approach the Bihar State Mahadalit Mission for the needful. Needless to state that at both the levels, no order shall be passed without affording reasonable opportunities to all the concerned parties.

With the aforesaid observation / direction, this petition stands disposed off.
