The petitioner apprehends his arrest in Mahila (Madhepura) P.S. Case No. 50 of 2015 registered for the offences punishable under sections 498-A and 323/34 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. The wife made allegation that the petitioner established illicit relation with one Annu Kumari and he solemnized second marriage with her. She also alleged that petitioner subjected her to all sort of torture. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife on any undertaking, the petitioner has not solemnized second marriage with Annu Kumari, on such, Mr. Sheo Kumar Kaushik, learned counsel appearing on

Patna High Court Cr.Misc. No.10583 of 2017 (3) dt.24-04-2017 2/2 behalf of the petitioner submits that the petitioner is ready to keep his wife if she is willing to live with her husband. Considering the fact that the wife is willing to live with her husband, the petitioner is directed to surrender in the court below within four weeks from the date of receipt/production of a copy of this order and on such, the court below shall grant provisional bail to the petitioner for four months on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhepura in Mahila (Madhepura) P.S. Case No. 50 of 2015.

The wife will also appear in the court below and on such, the court below shall make all efforts for resolution of the dispute between the husband and the wife. If the petitioner keeps his wife properly, the court below shall confirm provisional bail of the petitioner. If he fails to keep his wife properly, the court below shall pass order on the provisional bail of the petitioner after expiry of four months.
