The petitioner has filed the instant application for grant of regular bail in connection with Sakra P.S. Case no. 134 of 2019 registered under sections 420, 467, 468, 471 and 120B of the Indian Penal Code.

As per allegation in the F.I.R., a raid was conducted in the house of accused Rakesh Mahto @ Dhanna seth (not the petitioner herein). It is stated that cash and various other documents/articles relating to business of illicit liquor was recovered. He named his associates including the petitioner herein.

It is submitted by learned counsel for the petitioner that the accused where the raid was conducted bears the same

Patna High Court CR. MISC. No.41076 of 2020(2) dt.18-03-2021 2/2 name as the petitioner, however, it is Rakesh Mahto@Dhana Seth. It is submitted that except for his taking the name of the petitioner as one of his associates and his confession made before the police, there is no other material against this petitioner who is in custody since 3.2.2020 and has no criminal antecedent.

The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the period in custody, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Sakra P.S. Case no. 134 of 2019 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.IVth, Muzaffarpur.
