Heard learned counsel for the petitioner and the learned APP for the State.

Petitioner seeks regular bail in connection with Bikramganj P.S. Case No. 83 of 2022 registered for the offences punishable under Sections 341, 323, 354, 354(B), 504, 506 and 34 of the Indian Penal Code and Sections 8 and 12 of the POCSO Act.

As per the prosecution, the informant alleged that this petitioner along with a co-accused person tried to outrage the modesty of the informant's minor daughter aged about 17 years. The main submissions advanced by the learned counsel Mr. Ramashray Roy appearing for the petitioner are that

No.45389 of 2022(2) dt.29-11-2022 2/2 the FIR of the instant case was lodged ten days after the alleged occurrence and the said delay has not been explained in the FIR, petitioner is a cousin brother of the victim and on the alleged day of occurrence a dispute with regard to a drainage took place in between the petitioner's family and victim's family and thereafter the alleged occurrence was falsely prepared and FIR was lodged and a co-accused carrying similar nature of allegation has been granted bail by the Court below considering his plea of juvenility .

Learned APP Mr. Syed Mojibur Rahman appearing for the State has opposed the bail prayer.

Having considered the above submissions and mainly taking into account the petitioner's young age mentioned in the petition and his clean antecedent and custody period, in the opinion of this Court a lenient approach can be taken in respect of the petitioner's prayer, let the petitioner be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Bikramganj P.S. Case No. 83 of 2022.
