2. The petitioner apprehends his arrest in connection with Sherghati P.S. Case No. 1275 of 2023 registered under Sections 341, 323, 354-B, 448, 504, 506, 34 of the Indian Penal Code, and later on Sections 8 and 12 of POCSO Act were added.
3. As per prosecution case, on 24.12.2023 at 1:00 p.m., this petitioner, who is son-in-law of cousin uncle of victim, entered the house of victim and finding her alone attempted to molest her.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been
Patna High Court CR. MISC. No.47838 of 2024(3) dt.23-09-2024 2/2 implicated in the present case due to old enmity. Petitioner is none else but cousin brother-in-law of the victim. As a matter of fact, in view of the relationship between the parties, this petitioner teased the victim, on account of which she got angry, due to which this false and concocted case has been lodged. Petitioner has got no criminal antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.

Having considered the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge POCSO-cum-Additional Sessions Judge-VII, Gaya in connection with Sherghati P.S. Case No. 1275 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
