This application for anticipatory bail arises out of Town P.S. Case No. 182 of 2019 for the offence punishable under Sections 341, 448, 379, 384 and 506/34 of the Indian Penal Code.
The petitioners No. 1 and 3 are sons of petitioner No.2. It is alleged that they along with ten other miscreants entered into the house of the informant at 5 in the evening and, at the gun point, looted cash to the tune of Rs.40,000/-. They are said to have demanded extortion money and snatched jewellery of the female members of the family.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.42304 of 2019(2) dt.10-07-2019 2/2 petitioners has submitted that it is unbelievable that sons and the father would indulge together in such activity. He further contends that it is because of dispute between the informant and the family of these petitioners that false case has been lodged. Be that as it may, considering the nature of allegation and submissions advanced on behalf of the petitioners, this application is allowed.
Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur, in Town P.S. Case No. 182 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
