The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 307 and other sections of the Indian Penal Code.

As per allegations in the F.I.R., thirty two named accused persons including the petitioner herein as also 10-15 unknown persons variously armed surrounded the informant and members of his family and brutally assaulted them resulting in death of informant's father.

It is submitted by learned counsel for the petitioner that from perusal of the F.I.R. itself, it would transpire that five accused persons have been named to be carrying different weapons and the petitioner is not amongst them. The allegations

Patna High Court CR. MISC. No.41121 of 2020(4) dt.02-08-2021 2/2 are general and omnibus in nature with one line against the petitioner mentioning that he also participated. The petitioner is in custody since 7.8.2020 and has no criminal antecedent. The application for bail is opposed by learned A.P.P. for the State who submits that not only the petitioner is named in the F.I.R. but his participation is supported by the material that has transpired in course of investigation as also the postmortem report. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner as contained in the F.I.R. together with petitioner having remained in custody for more than 10 months, the Court directs the petitioner to be enlarged on bail in connection with Dariyapur P.S. Case no.265 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 13th , Saran at Chapra.
