Petitioner apprehends his arrest in connection with Mahua P.S. Case No. 375 of 2015 registered under Sections 147,148,149,353,323,332,333,342,337,338 and 435 of the Indian Penal Code and 3⁄4 of the ESM Act.
It has been submitted on behalf of the petitioner that there is general and omnibus allegation against the petitioner. From the written report it appears that about 200 persons blocked the road on account of death of one Naresh Rai and when the police went to remove the mob, they pelted stones at police party in which several police received injury. Also the mob obstructed the police party in discharging their official duty.
Patna High Court Cr.Misc. No.7055 of 2017 (2) dt.21-02-2017 Considering the facts and circumstances of the case, the prayer of anticipatory bail of the petitioner is allowed. The petitioner, above named, in the event of arrest or surrender within period of six weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Mahua P.S. Case No. 375 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
