====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is languishing in custody since 24.05.2019 in a case for the offence registered under Sections 365 and 366(A) of the IPC.

The prosecution story, in brief, is that on 13.02.2019 at 5.00 A.M. the minor grand-daughter of the informant namely, Ranjana Kumari aged about 14 years, had gone to field but she did not return back after some time. On search from the people, he came to know that F.I.R. named accused persons took away his grand-daughter forcibly on Bolero vehicle of Banti Kumar somewhere. He alongwith his family members went to the father of Banti Kumar, namely, Gaurishankar Sah then he told that the accused persons had kidnapped his grand-daughter for

It has been submitted by learned counsel for the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The statement of the victim has been recorded under Section 164 Cr. P.C. There is no allegation of sexual and physical harassment against the petitioner. The victim had left out of her own will alongwith the petitioner. On behalf of the learned counsel for the State, it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.- 11, Gopalganj, in connection with Gopalpur P.S. Case No. 33/2019.
