JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-02-2017 This is an application for grant of anticipatory bail for offences punishable under Section 47 (A) of the Bihar Excise Act.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that allegation against the petitioner is that he along other persons was selling foreign liquor from an Alto Car. It is further submitted that except the recovery of photo copy of petitioner's driving licence from the car, there is nothing against the petitioner. He is in no way concerned with the recovery and the car is of some other person.

Heard learned A.P.P. also.

Having heard both sides, in view of the allegation of

Patna High Court Cr.Misc. No.7514 of 2017 (2) dt.22-02-2017 2/2 selling foreign liquor from the car, I am not inclined to grant anticipatory bail to the petitioner, the same is rejected. However, petitioner is directed to surrender in the court below, i.e., learned Chief Judicial Magistrate, Saharsa, in connection with Misc. Case no. 260 of 2016 and make prayer for regular bail which will be considered on the basis of material on record and pass an appropriate order without being prejudiced by the order of this Court.
