The petitioner seeks bail in a case registered under Sections 21(c), 22 of N.D.P.S. Act and Sections 27(ii), 28 read with Section 36 of Drugs and Cosmetics Act.

Allegation is that huge quantity of intoxicated drugs are recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.01.2019. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. Alopathic injections are said to have been recovered. None of those medicines come under the N.D.P.S. Act. There is no compliance of Section 100

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions -cum-Special Judge, Araria in connection with Special (NDPS) Act case No.22 of 2018 arising out of Jogbani P.S. case NO.235 of 2018.
