The petitioner apprehends his arrest in connection with Begusarai Town P.S. Case No. 33 of 2016, registered under Sections 420, 406, 407, 386, 323 and 504/34 of the Indian Penal Code, pending in the court of the Chief Judicial Magistrate, Begusarai.
The accusation is that petitioner, being the servant at the firm of complainant, received Rs. 2,50,000/- to deposit the same in the Bank, but the said amount has not been deposited by the petitioner and his mobile phone was also found switched off. On 18.12.2015, informant and others went to the house of petitioner and demanded his money back, but petitioner did not
Patna High Court Cr.Misc. No.15228 of 2017 (4) dt.10-07-2017 2/2 return his money and started assaulting him with the butt of pistol and forcibly took Rs. 10,000/- from the informant. Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case.
Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, his prayer for grant of anticipatory bail stands rejected. The petitioner is directed to surrender before the trail Court within six weeks and pray for regular bail, which would be considered by the trial Court in accordance with law without being prejudiced by the order of this Court.
