JUSTICE VIKASH JAIN ORAL ORDER 21-12-2018 Pursuant to order dated 17.12.2018, learned counsel for the petitioner proposes the name of Hon'ble Mr. Justice Ramesh Kumar Datta, a retired Judge of this Court whose consent has been obtained for appointment as sole learned Arbitrator, to which the respondents have no objection.

2. In the above view of the matter, this Court accordingly appoints Hon'ble Mr. Justice Ramesh Kumar Datta, a retired Judge of this Court residing at Sukriti Apartment, S.P.

Patna High Court CWJC No.8913 of 2015(3) dt.21-12-2018 2/2 Verma Road, Patna, as the sole learned Arbitrator for resolution of the disputes between the parties in accordance with the provisions of the Act.

3. The petitioner must approach the learned Arbitrator within one month along with a certified copy of this order and file his statement of claims, whereupon the learned Arbitrator would proceed with the adjudication. The fees of the learned Arbitrator shall abide by the Fourth Schedule of the Act, and shall be borne equally by the parties.

4. With the aforesaid directions, the writ petition stands disposed of.
