The petitioner apprehends his arrest in connection with Barari P.S. Case no. 41 of 2016, registered under Sections 363, 363(A), 365, 367, 368 and 120(B) of the Indian Penal Code. The accusation is that petitioner used to visit the house of complainant/informant Bablu Kumar Thakur and on the pretext to go to Bhagalpur he was carried at the house of one Karu Thakur, where his marriage was performed with Deoki Kumari, daughter of Karu Thakur, who was five years older than him.

Learned counsel for the petitioner submits that petitioner is innocent and he has falsely been implicated in this case. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case,

No.6373 of 2017 (2) dt.03-04-2017 2/2 let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Katihar in connection with Barari P.S. Case No. 41 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
