Shakir Ahmad, learned Additional Public Prosecutor for the State via virtual mode. Petitioner seeks regular bail in connection with Shastri Nagar PS Case No. 199/2021 registered for the offence punishable under Sections 30(a), 30 (c) of Bihar Prohibition & Excise Act, 2016.

The police on the basis of secret information proceeded to the place of occurrence and arrested the petitioner along with other accused persons and recovered altogether 404 litres of illicit liquor.

Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case due to oblique motive. He further submits that no illicit liquor has been

He next submits that the charge-sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidences.

Regards being had to the submissions made by the parties and taking into consideration the material on record and the fact that no illicit liquor has been recovered from the conscious possession of the petitioner, petitioner is in custody since 02.06.2021 having no criminal antecedent, the chargesheet has been submitted in the matter and there is no likelihood that the petitioner will abscond or tamper with the evidences, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, named above, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge- Excise, Patna in connection with Shastri Nagar PS Case No. 199/2021.
