2. The petitioners have preferred this application for grant of regular bail in connection with Jamui Rail P.S. Case No. 12/2025 dated 16.05.2025 registered for the offences punishable u/ss 103, 61(2), 238 of the Indian Penal Code.
3. As per the prosecution case, It is alleged that the informant's son was in love affair with Bindu Kumari (petitioner no. 1) and solemnized marriage with her, for that reason the petitioners and the co-accused persons assaulted the informant and her family members and threatened to kill her son. It is further alleged that the informant's son also informed that the co-accused persons Guddu, Diwakar, Raju and Raj Kumar were coming to the Railway Station to receive him, after that the mobile phone of the informant's son got switched off. It is further alleged that the informant came to know that the petitioners and the co-accused persons killed her son under conspiracy.
4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. It is further submitted that both the petitioners are ladies. The petitioner no. 2 is the wife and the petitioner no. 1 is the mother-in-law of the deceased. There is no material available against the petitioners except suspicion. It is further submitted that when the petitioner no. 2 solemnized marriage with the deceased, she herself has given statement in favour of him and thereafter, the deceased has been acquitted of that case. The petitioner no. 1 has one criminal antecedent and the petitioner no. 2 has clean antecedent as stated in para 3 of the bail petition. The petitioners are in custody since 17.05.2025.
5. Learned counsel for the informant as well as
Patna High Court CR. MISC. No.46617 of 2025(4) dt.15-09-2025 3/3 learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners by submitting that the at the time of alleged occurrence, the petitioners and the co-accused persons were in contact with the deceased.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners above-named, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Kiul, Lakhisarai in connection with Jamui Rail P.S. Case No. 12/2025, with the condition/s:- (i). The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to cancelled. (ii). The petitioners are directed to cooperate in the trial before the learned trial court below.
