JUSTICE VINOD KUMAR SINHA ORAL ORDER 02-05-2017 The petitioners are apprehending their arrest in connection with Sasaram P.S. Case No. 146 of 2017, registered for offences punishable under Sections 30(a) of Bihar Excise and Prohibition Act, 2016.
It has been submitted on behalf of the petitioners that they have falsely been implicated in this case as the land from which the alleged recovery has been made does not belong to petitioners.
Heard learned A.P.P. also.
Having heard both sides, in view of Section 76(2) of Bihar Excise Act, I am not inclined to grant the petitioner privilege of anticipatory bail.
Patna High Court Cr.Misc. No.18032 of 2017 (2) dt.02-05-2017 2/2 Let petitioner surrender before the Court below and pray for regular bail and if any such application is filed, the court below after considering the submissions of learned counsel for the petitioner, shall pass an appropriate order, if possible, on the same day, without being prejudiced by the order of this court. With the above observation, this application is disposed of.
