The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47A of the Excise Act.
It is alleged that raid was laid in the house of Gobind Bharati, where a pick up van was found parked. From the house of Gobind Bharati 3780 sachets of 200 M.L. each country made liquor were recovered. Govind Bharati disclosed that the liquor belongs to this petitioner and Arun Singh.
It is submitted by the learned counsel for the petitioner that only the pick up van is registered in the name of the petitioner, whereas the liquor in question is
Patna High Court Cr.Misc. No.13213 of 2015 (2) dt.31-03-2015 claimed by one Akhilesh Rai. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the fact that the recovery has not been made from the possessions of the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Saran at Chapra in connection with Rasulpur P.S. Case No. 77 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
