The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 363, 366A/34 of the Indian Penal Code.

Accusation is of kidnapping the minor sister of the informant for the purpose of marriage.

It is submitted by the learned counsel for the petitioners that the victim married with Munnan Kumar of her own. The petitioners are mother, unmarried sisters and relatives of co-accused Mannan Kumar. It is submitted that certified copy of the statement under Section 164 Cr.P.C. of the

Patna High Court Cr.Misc. No.14149 of 2015 (2) dt.06-04-2015 victim has been produced wherein she got her age recorded 23 years, the Court also assessed her aged 21 years. In statement under Section 164 Cr.P.C. she has stated that her uncle Kripa Shankar Singh took her to Kali Mandir at Patna, where she married with Munnan Kumar. Statement has been made in para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sheohar in connection with Tariyani P.S. Case No. 248 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
