Petitioners apprehend their arrest in connection with Dighwara P.S. Case No. 104 of 2014 registered for the offences alleged under Sections- 341, 323, 353/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioners were released on police bail on 27.01.2015 under section 41(1) of the Code of Criminal Procedure. Considering the facts and circumstances of the case it appears that the matter is well covered by the decision of this Court in the case of Mahendra Prasad Singh Vs. State of Bihar, reported in 2004 (3) P.L.J.R., 491.

Patna High Court Cr.Misc. No.6676 of 2017 (5) dt.18-05-2017 2/2 Accordingly, it is directed that petitioners may surrender before the Court below within a period of four weeks from today. In case petitioners surrender and file their applications for bail, the concerned Court will pass an order in the similar manner as has been decided in the case of Mahendra Prasad Singh (supra).

The application stands disposed of with the above observations/directions.
