JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-06-2015 Heard learned counsel for the petitioner, learned counsel for the informant as well as learned Additional Public Prosecutor for the State.

Petitioner apprehends her arrest in connection with Gaya Civil Lines P.S. Case No. 660 of 2014 registered for the offences punishable under Sections 304B, 201 of the Indian Penal Code.

Petitioner happens to be mother in law of the deceased who died within six months of her marriage. No doubt, there is allegation of torturing as well as demand of dowry but in course of investigation, several witnesses stated that on the alleged date of occurrence, they came to know that deceased died of cold and after her death information to the informant was given but

Patna High Court Cr.Misc. No.12817 of 2015 (4) dt.26-06-2015 informant could not reach in time and thereafter, the dead body of the deceased was cremated.

Considering the aforesaid facts and circumstances as well as this aspect of the matter that petitioner is an old lady, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of her arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gaya in Gaya Civil Lines P.S. Case No. 660 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
