2. The petitioners are apprehending their arrest in connection with Khodawandpur P.S. Case No. 59/2023 registered for the offences punishable under Sections 341, 323, 452, 324, 342, 504, 506, 34 of the Indian Penal Code.
3. As per prosecution case, petitioners are said to have caught the informant and closed in a room, reason behind this occurrence is that the informant demanded the share of increased pension amount of his mother. It is alleged that petitioner no.1 is said to have assaulted the informant with pagharia as a result of which he sustained injury and informant
Patna High Court CR. MISC. No.48923 of 2024(2) dt.07-08-2024 2/3 was also assaulted by legs-fists. When the informant's son came there, then the petitioners also assaulted him. It is further alleged that the petitioners also assaulted the informant's wife and both threatened the informant to kill him if he demanded his share.
4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence as alleged in the FIR and they have falsely been implicated in this case. The informant and the petitioners are full brothers. He further submits that no one has sustained any injury except informant's wife and the injury sustained by informant's wife is simple in nature. Petitioners bear no criminal antecedent.
5. The learned A.P.P. for the State opposed the prayer for anticipatory bail of the petitioners.
6. Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioners, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M.,
