The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 353, 224, 225, 34 of the Indian Penal Code.

It is alleged against the petitioner that he fled away from the police station after pushing the police personal. The petitioner was taken under custody for interrogation in a kidnapping case.

It is submitted by learned counsel for the petitioner that no such occurrence as alleged in the F.I.R

Patna High Court CR. MISC. No.55644 of 2021(3) dt.22-06-2022 2/3 has ever taken place and the whole prosecution story is false, fabricated and concocted. In fact, the petitioner was arrested by the police without any evidence in connection with Dhamdaha P.S. Case No. 359 of 2018 on 10.02.2019 and was kept in Haazat for three days and set free on 13.02.2019 with an assurance that he will pay bribe to the police and when the illegal demand of police could not be fulfilled, this false case has been lodged against the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Dhamdaha P.S. Case No. 45 of 2019,
