JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 01-05-2015 This application under section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 02.04.2015 passed by the learned Sub Divisional Judicial Magistrate, East Muzaffarpur in Complaint Case No.C-1184 of 2007/ Tr. No. 952 of 2015 making an order for issuance of fresh non-bailable warrant of arrest against the petitioner. In view of the nature of dispute, in case the petitioner surrenders within two weeks from today, the court below is directed to release him on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties to its own satisfaction.

Patna High Court Cr.Misc. No.18518 of 2015 (2) dt.01-05-2015 2/2 If the petitioner surrenders within the stipulated period of two weeks, all previous order/orders issuing warrant of arrest (bailable or non-bailable) against the petitioner in the aforementioned case shall stand quashed.

In case, the petitioner fails to surrender within the stipulated period, all previous order passed by the court below issuing warrant of arrest (bailable or non-bailable) shall take its full effect and the Magistrate concerned shall take all sort of coercive steps to ensure his appearance before the court. With the aforesaid observations and directions, the application is disposed of.
