JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2017 This is an application for grant of anticipatory bail for offences punishable under Section 394 of the Indian Penal Code.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner and he has no criminal antecedent.
Heard learned A.P.P. also.
Considering the fact that this case is under Section 394 of the Indian Penal Code and petitioner is named in the F.I.R., I am not inclined to grant anticipatory bail to the petitioner, the same is rejected.
However, petitioner is directed to surrender in the
Patna High Court Cr.Misc. No.7583 of 2017 (2) dt.27-02-2017 2/2 court below, i.e., learned Addl. Chief Judicial Magistrate-III, Sheikhpura, in connection with Jayrampur P. S. Case no. 54 of 2016 and make prayer for regular bail which will be considered on its own merit without being prejudiced by the order of this Court. This application is according disposed of.
