For the Petitioner/s : Mr. Anil Kumar Singh, Adv. For the Opposite Party/s : Mr. Md.Ataur Rahman(APP) ====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 03-07-2015 Heard both sides.
The petitioner apprehends his arrest in Rajoun P.S. Case No. 29 of 2015, registered for the offences punishable under Sections 504 and other Sections of the Indian Penal Code and 27 of Arms Act.
There is allegation against the petitioner that he fired on the informant but the firing did not hit the informant. It is submitted that there is a case and counter case. From the side of the petitioner Rajoun P.S. Case no. 30/2015 was filed against the informant and others. Nobody got injured. All the co-accused have already been enlarged on bail, even the accused of counter case have already been granted anticipatory bail.
Patna High Court Cr.Misc. No.20052 of 2015 (3) dt.03-07-2015 But it appears that the petitioner is very specifically alleged to have fired.
Hence, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
