Mr. Upendra Kumar ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 25-01-2022 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State through video conferencing.
The learned counsel for the petitioner is directed to remove all the defects pointed out by the office within one month. The petitioner apprehends his arrest in connection with Barari P.S. Case No. 194 of 2020 registered for offence punishable under sections 406, 420, 427, 504 and 506 of the Indian Penal Code.
The learned counsel for the petitioner has submitted that the Mata Mukho Kaur-Sampato Kaur Trust has leased the trust property to co-accused Sardar Jit Singh, but he did not pay the arrears of the rent of Rs. 10,59,000/-. The Committee has taken back that land from Sardar Jit Singh and the Committee itself
Patna High Court CR. MISC. No.40567 of 2020(7) dt.25-01-2022 2/2 started cultivation on that land. The allegation against Sardar Jit Singh is that he destroyed the crops and also threatened the members of the Committee to face dire consequences. The learned counsel for the petitioner has submitted that there is no allegation of destroying of crops against the present petitioner nor the allegation of threatening the members of the Committee, has been levelled against the petitioner. Considering the above mentioned facts and circumstances, the petitioner above named, in the event of his arrest or surrender, within four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Katihar in connection with Barari P.S. Case No. 194 of 2020, subject to condition as laid down under section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
