====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 04-04-2017 Heard both sides.

The petitioners apprehend their arrest in Goh P.S. Case No. 173 of 2015 registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant named 15 persons including these four petitioners and alleged that Manoj Kumar assaulted his son Ramesh Kumar with dagger and the accused persons were trying to kidnap him but on alarm the accused persons fled away. Learned counsel for the petitioners submits that the petitioners are not alleged to have assaulted the son of the informant. There is no specific allegation against the petitioners. There is a counter version being Goh P.S. Case No. 172 of 2015.

Considering the facts aforesaid and the fact that Ramesh Kumar, son of the informant, got one injury which is simple in nature and there is no specific allegation against the petitioners and there is counter version, the petitioners above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in Goh P.S. Case No. 173 of 2015, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
