This is an appeal under Section 14A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter referred to as the "SC/ST Act") against the order dated 16.02.2018 passed in S.C./S.T. Reg. No.222 of 2017, arising out of Chainpur Police Station Case No.112 of 2011 by the learned Additional Sessions Judge-1st-cum-Special Judge, Kaimur at Bhabhua, whereby the learned trial court has rejected the prayer of the appellants under Section 227 of the Code of Criminal Procedure to discharge.
Patna High Court CR. APP (SJ) No.1838 of 2018 dt.29-10-2018 2/2 Learned counsel for the informant submits that the trial is going on and about seven prosecution witnesses have already been examined in this case.
I have gone through the nature of allegation in the F.I.R. as well as statement of the injured and have also considered the stage of the trial. I do not find any reason to interfere with the impugned order at this stage. Hence, this appeal is dismissed as devoid of any merit.
However, this order would not prejudice the mind of the trial court in any way.
