The petitioner apprehends his arrest in connection with Giriyak (Katrisarai) P.S. Case No. 357 of 2016, registered for the offences punishable under Sections 353, 333 of the Indian Penal Code and Section 27 of the Arms Act.

Allegedly, the petitioner started making discussion with the police and in the meantime co-accused Mukesh Kumar Singh after opening fire fled away with his son Tamatar and Tamatar was abusing the police party.

Submission is of false implication and that Tamatar has already been allowed pre-arrest bail by the learned court below vide A.B.P. No. 129 of 2017, the case of the petitioner is on better

Patna High Court Cr.Misc. No.11426 of 2017 (3) dt.19-04-2017 2/2 footing than that of Tamatar and, as such, the petitioner deserves sympathetic consideration.

The learned A.P.P. submits that it was the petitioner who started making discussion with the police and in the meantime Mukesh Kumar Singh fled away after opening fire with his son Tamatar.

In the facts and circumstances as stated above, considering that there is nothing against the petitioner to help Mukesh Kumar Singh in fleeing away and, as such, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Nalanda at Biharsharif, in connection with Giriyak (Katrisarai) P.S. Case No. 357 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C. (Jitendra Mohan Sharma, J.) Rajiv/- U T
